Liability Waiver & Assumption of Risk Agreement
This Liability Waiver and Assumption of Risk Agreement (“Agreement”) must be read and signed by all participants before boarding the vessel operated by Don't Worry Boat Charters.
By signing this Agreement, the participant acknowledges and agrees to the following:
The participant understands that boating and water-related activities involve inherent risks that cannot be eliminated regardless of the level of care taken by the vessel owner, captain, or crew.
- Slipping or falling on wet surfaces
- Movement of the vessel due to waves, wake, or weather conditions
- Injuries during boarding or disembarking the vessel
- Injuries related to swimming or water exposure
- Equipment malfunction or marine-related hazards
By participating in this charter and boarding the vessel, the participant voluntarily assumes all risks, known or unknown, associated with boating activities.
In consideration for being permitted to participate in the charter, the participant agrees to release, waive, and discharge Don't Worry Boat Charters, its owners, operators, captains, crew members, employees, contractors, and affiliates from any and all liability for:
- Personal injury
- Property damage
- Loss or theft of personal belongings
- Accidents or incidents occurring before, during, or after the charter
This release applies to any claims arising from participation in the charter activities.
The participant agrees to indemnify and hold harmless Don't Worry Boat Charters, its owners, captains, and crew from any claims, damages, legal actions, or expenses arising from the participant’s actions or negligence while onboard the vessel.
The captain has full authority over the vessel and passengers at all times. Any guest engaging in unsafe, illegal, or disruptive behavior may be removed from the vessel or have the charter terminated without refund.
- Charters are BYOB (Bring Your Own Beverages)
- Excessive intoxication will not be tolerated
- Illegal substances are strictly prohibited
- Guests must behave responsibly at all times
The captain reserves the right to terminate the charter if safety becomes a concern.
Charters operate rain or shine. The captain retains the sole authority to determine whether weather or lake conditions are safe to operate. If conditions are deemed unsafe, the charter may be rescheduled at the discretion of the company.
Participants acknowledge that Don't Worry Boat Charters is not responsible for lost, stolen, or damaged personal belongings brought onboard the vessel.
Participants confirm that they are physically capable of participating in boating activities and do not have any medical condition that may put themselves or others at risk.
Participants assume responsibility for any medical conditions that may arise during the charter.
Participants grant permission for photos or videos taken during the charter to be used for promotional, marketing, or social media purposes by Don't Worry Boat Charters unless otherwise requested in writing.
By signing below, the participant acknowledges that they have read and fully understand this Liability Waiver & Assumption of Risk Agreement, voluntarily agree to all terms and conditions stated above, and understand that this document releases certain legal rights.
